CARE Challenge Medical Form Disclaimer

Participants will appreciate that a CARE Challenge Event is designed to involve strenuous exercise. You should be aware of this and should consider carefully (and, if appropriate, consult a medical practitioner) whether your general level of fitness, or any particular illness or ailment suffered by you, should preclude your participation. If you are affected by any condition that is likely to be exacerbated by strenuous exercise, for example heart disease, asthma, obstructive airways disease or similar ailment, you should refer to Ella Moffat at CARE International UK on 020 7091 6111 before completing this form.

If you are in any doubt as to your physical condition and your ability to participate in this event, you should seek advice from their medical practitioner prior to taking part.

I have read and understood the advice given with regard to my participation in a CARE Challenge Event and confirm that I consider myself to be fit and healthy enough and physically able to participate in the Challenge. I am/will be over the age of 18 by the date of the event.

I am aware that I will be participating in an outdoor environment on uneven terrain where I may encounter weather conditions which can change rapidly and without warning.  I understand that access to emergency medical assistance may not be readily available in these environments.

I understand that in the event that, during the Challenge, if I am or become in the sole judgement of a CARE representative on site, incapable of participation or continued participation without risk or prejudice to myself, fellow expedition members or CARE International UK staff, CARE International UK reserves the right to declare my participation or continued participation terminated.

I acknowledge that I will be participating in the CARE Challenge Event entirely at my own risk and am expected to take the necessary precautions appropriate to the weather and other conditions.  I voluntarily assume all of the known and unknown risks that may result both from my participation in the Challenge itself and in transportation to or from the programme route and any rescue operations or procedures, including, without limitation, the risk of personal injury, death of damage to person or property and any loss, costs or expenses which may result from such events.  I also acknowledge that neither CARE International UK nor The Sponsor (if applicable) shall be liable for death or bodily injury sustained by any participants other than in respect of death or bodily injury caused by their negligence or the negligence of their employees or servants.

This agreement and any dispute or claim whatsoever relating to it or its formation shall be governed by and construed in accordance with English law and the parties irrevocably agree that the courts of England shall have exclusive jurisdiction.

Osborne Clarke Going for Gold Terms & Conditions

These are the Terms & Conditions, for your reference, that you accepted when registering for your CARE Challenge.  If you have any questions relating to these please get in touch with the Challenge Team.

Before registering for and participating in the "Osborne Clarke Going for Gold" taking place on 28 September 2012 ("Event"), each individual participant ("you" or "Participant") must agree to the following terms and conditions of entry:

1.	CARE International UK (Charity No. 292506) whose registered office is at 9th Floor, 89 Albert Embankment, London, SE1 7TP ("CARE"/"us"/"we") is acting, in certain respects, as an agent for the tour operator that organises the Event, which is Threshold Sports Ltd (company number 6430519) whose registered office is at 11 Maiden Lane, Covent Garden, London, WC2E 7NA (the "Tour Operator"). 
2.	Participants must be at least 18 years of age before the date of the Event. Participants aged 16 or 17 years old at the date (or any date where applicable) of the Event may take part but each such Participant must be accompanied for the duration of the Event by a responsible adult.
3.	Participants must be sufficiently fit to undertake the Event, be competent cyclists and must comply with all laws and regulations applicable to their participation in the Event.
4.	Participants will be required to complete a medical form as part of the registration process and to provide any other medical information as requested by CARE. You must also disclose to CARE in full any dependency on alcohol or illegal or prescription drugs at the time of registering for the Event. You may be required to provide a note from your doctor confirming that it is safe for you to participate in the Event. You agree that in any event it is your responsibility to make an assessment of your health and fitness for this Event. If you cannot make such an assessment or if you are in doubt, you must consult your doctor before participating in the Event. You agree that CARE is not responsible for assessing your medical conditions or fitness to participate in the Event, and does not assume such responsibility by permitting you to participate in the Event.
5.	If any person has any medical problem or disability which may affect participation in the Project, this person shall inform CARE as soon as reasonably practicable so that CARE can advise as to the suitability of the chosen arrangements.  If CARE, the Tour Operator or their agents are unable to accommodate the particular needs of the person concerned and reasonably believe that his or her health and/or safety would be put at risk by his or her participation in the Project, CARE reserves the right to decline the participation of that person.  
6.	CARE has the right to refuse participation of any Participant in the Event if any Participant is deemed by CARE to be medically unfit to take part in the Event or is found to have consumed or to have in their possession any drugs, illegal substances, performance enhancing substances or intoxicants of any kind.  
7.	Participants shall participate in the Event at their own risk and acknowledge that participation in the Event may involve inherent risks of accidents and injury. You acknowledge that CARE, the Tour Operator and their agents shall be released and not be liable in any way for any injury, death, loss or damage to you, your personal property or any third party during or as a result of your participation in the Event (or for the avoidance of doubt, as a result of activities conducted outside the scope of the Event), except where your death or personal injury results from CARE's, the Tour Operator's or their agents' own negligence.
8.	You agree to be responsible and liable for any costs incurred in repairing any damage to property or accommodation caused by you or otherwise as a result of Participants' conduct, and agree to indemnify, defend and hold harmless CARE, The Tour Operator and their employees, servants and agents against any claims for loss or damage to accommodation or property, as a result of Participants' conduct, or injury or death provided such injury or death does not result from CARE's, the Tour Operator's or their agents' own negligence.
9.	Participants must provide their own personal equipment, including bicycle, helmet, bell and lights and such equipment must be suitable for the Event.
10.	Participants agree to send a registration fee of £25 to CARE within two 2 weeks of receipt of confirmation of their registration to show commitment to the Event (the "Deposit").  We suggest that Participants show a further commitment of £200 before the Event.  This timetable will help ensure that Participants reach their individual target (the "Further Amount"). It is recommended that the remaining balance of £250 is raised within one 1 month following the Event.
11.	Participants agree to raise the minimum sponsorship specified for the Event, such amount being £450 per individual Participant exclusively for CARE (the minimum sponsorship of £450 and any surplus donation constituting together the "Sponsorship Monies").  This does not include your registration fee or Gift Aid as it is not guaranteed.  Sponsorship Monies raised for this challenge cannot be restricted and will go to wherever the CARE International UK Senior Management Team deems there is the greatest need.

12.	Participants acknowledge that itineraries, schedules and other details of the Event may be subject to change by CARE or The Tour Operator and CARE will not be liable for any adverse consequences arising from such changes. 
13.	CARE further reserves the right to cancel or terminate the Event. If the Event is cancelled by either CARE or the Tour Operator for any reason other than your failure to comply with these terms and conditions; as a result of an event occurring less than eight weeks before the Event start date which is outside our control; or if CARE considers that it is unlikely to make a surplus in relation to this Event, the registration fee will be refunded to you.  However, as the purpose of this Event is to raise money for charity, the Further Amount and the Sponsorship Monies will, in this instance, only be refunded to you if you so request in writing, to the exception of those monies paid via online donations which will not be refunded.
14.	In the event that you are unable to participate in the Event for any reason, you must inform CARE in writing promptly. The registration fee, Further Amount and all Sponsorship Monies raised will be retained by CARE by way of donation.
15.	CARE further reserves the right to remove a Participant from participation in the Event if, in CARE's opinion your behaviour is disruptive or is likely to affect other Participants or third parties or cause damage to property, is likely to be in breach of these Terms and Conditions, or is threatening or abusive towards CARE or the Tour Operator and their representatives, agents or suppliers in the UK or overseas. No refunds or reduction in any of the fees paid by such Participant to CARE, including the Deposit, Further Amount and any Sponsorship Monies, will be made.
16.	Participants agree to comply with the scheduled itinerary for the Event and with all directions and instructions given by CARE, The Tour Operator and their representatives at all times during the Event.
17.	Participants agree to fundraise using legal methods.  Where uncertain as to the legality of your methods, please consult CARE. 
18.	Participants agree to allow CARE to use photographs and video recordings taken of them at the Event for the purpose of raising awareness and/or funds.
19.	Participants are responsible for organising their own travel/ health insurance for the purposes of the Event and understand that CARE's insurance policy does not cover them.
20.	You must provide your own personal equipment, including bicycle, helmet, bell and lights and such equipment must be suitable for the Event.
21.	You are responsible for making your own food, accommodation and travel arrangements to the Event. You acknowledge that changes of name or departure details (such as date and time) may not be permitted by airlines or other transport providers and such changes may be treated as a cancellation of your booking and you may be charged accordingly.
22.	By entering and providing the required entry information, Participants acknowledge that CARE may send them information about CARE and its work or contact them for future donations, by telephone, mail, email or other means, unless they shall otherwise request in writing.  Information collected from all entrants is subject to CARE privacy policies located at www.careinternational.org.uk/privacy-policy.  If you do not wish to share your information, please do not enter this Event.
23.	As part of our support, we provide teams with access to online resources. Please check the box below to indicate that you to agree to use CARE’s name and logo only in accordance with the following terms and conditions:
a.	Participants will use the name and logo only in accordance with the branding guidelines provided in the online resources; 
b.	Participants will use the name and logo only for fundraising for CARE and in connection with your participation in the Event and for no other purpose; 
c.	Participants acknowledge that CARE, as a secular humanitarian organisation working towards ending world poverty, has a reputation that is critical to its work. Accordingly Participants agree that you will not do anything in connection with your use of the CARE name and logo that might damage the reputation of CARE; and 
d.	Participants acknowledge that this permission is personal to your team and is not assignable or transferable to any other person.
24.	These terms and conditions are governed by the laws of England and subject to the exclusive jurisdiction of the courts of England and Wales.
